The three elements of a successful negligence claim

3 – ‘Causation’

The final piece in the jigsaw is what lawyers call ‘causation’.

In very simple terms, this means that there has to be a sufficient link between the negligent advice and the loss/ damage suffered. The loss or damage must flow as a consequence of the negligent advice. In other words, the loss must be caused by the negligent advice rather than being a loss that, for example, would have happened anyway.
